Missouri Underground Facility Safety and Damage Prevention Statute RSMo 319.0154 - 319.050
The Missouri Attorney General’s Office is concerned with safeguarding the lives and property of the citizens of Missouri as related to the programs detailed in Chapter 319. In cooperation with Mo One Call Systems Inc., the Public Service Commission and, both, the utility and excavation industries, the Attorney General’s office has developed an approach for addressing violations of RSMo 319. We feel we have put together an enforcement plan built on fair and effective enforcement for all parties involved.
The Attorney General’s office’s priority is not with one-time issues which occasion little or no damage – those matters are best resolved with the entities directly involved. However, repeat violations of Chapter 319 and any single violation which leads to serious damage to property or risk of injury to human health will be pursued appropriately. Any violation causing serious property damage and repeat violations should be reported to the Attorney General’s office. Please include as much information on the incident as possible, such as the date and locations of violations, and names of companies or individuals.
Of course, the Attorney General’s Office reserves the flexibility to treat any violation of RSMo 319 on a case-by-case basis as the circumstances of individual violations warrant.
